IntentThe first element of a contract is the intent to create legal relations. For a contract to be valid the initial question is if the two parties held the intent to create a legal contract. This is determined by whether or not the agreement was based upon a domestic or a social agreement. If there is lack of intent to create legal relations the contract will be found invalid.
