the plaintiff was contracted to work as one of 11 seamen for a voyage. The plaintiff was only supposed to receive $5 a month but during the voyage but two of the employees had deserted the voyage and the captain then made agreement to split the wages of the 2 deserters between the other employers. Courts findingThe agreement was not enforceable as the plaintiff gave no consideration for the promise to pay. Furthermore the plaintiff as well as the other employees had already been in agreement to work for the employer for the current wages and were bound by the contract to ensure the voyage reached its end.
